These Terms of Use ("Terms") govern your access to and use of the Abs Lock mobile application (the "App") and the website at abslock.app (the "Site"), collectively referred to as the "Services," operated by Abs Lock ("we," "us," or "our").
By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, do not use the Services.
1. Eligibility
You must be at least 13 years old (or 16 in the EEA) to use the Services. By using the Services, you represent that you meet this age requirement and have the legal capacity to enter into these Terms.
2. Account Registration
To access certain features, you must create an account using Apple Sign-In or Google Sign-In. You are responsible for:
- Maintaining the security of your account credentials
- All activity that occurs under your account
- Notifying us immediately of any unauthorized use
We reserve the right to suspend or terminate accounts that violate these Terms.
3. The Services
Abs Lock is an alarm clock application that requires you to perform camera-verified sit-ups to dismiss alarms. The App uses on-device pose detection to count reps. Key aspects of the Services include:
- Setting alarms with customizable rep targets
- Camera-based sit-up detection and counting
- Streak tracking and progress history
- A gorilla mascot that provides feedback on your performance
4. Subscriptions and Payments
Free and Premium Tiers
Abs Lock offers both free and premium subscription plans. Premium features are available through monthly or annual subscriptions.
Billing
Subscriptions are billed through the Apple App Store or Google Play Store. By subscribing, you agree to the pricing and payment terms presented at the time of purchase.
Auto-Renewal
Subscriptions automatically renew at the end of each billing period unless you cancel at least 24 hours before the renewal date. You can manage and cancel subscriptions through your device's app store settings.
Refunds
All purchases are final. Refund requests are handled by Apple or Google according to their respective refund policies. We do not process refunds directly.
5. Acceptable Use
You agree not to:
- Use the Services for any unlawful purpose
- Attempt to reverse engineer, decompile, or disassemble the App
- Interfere with or disrupt the Services or servers
- Attempt to bypass the alarm dismissal mechanism through any means other than completing the required reps
- Use automated tools, bots, or scripts to interact with the Services
- Create multiple accounts to abuse free-tier features
- Impersonate another person or entity
- Collect or harvest information from other users
6. Intellectual Property
All content, features, functionality, designs, graphics, trademarks, and other intellectual property in the Services (including the gorilla mascot and "Dark Krunk" design system) are owned by Abs Lock and are protected by copyright, trademark, and other intellectual property laws.
You are granted a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes in accordance with these Terms.
7. Camera and Device Permissions
The App requires camera access to detect sit-up reps. By granting camera permission, you acknowledge that:
- All pose detection processing occurs on your device
- No camera images or video are transmitted, stored, or shared
- You can revoke camera access at any time through your device settings, though this will prevent alarm dismissal via sit-ups
8. Health Disclaimer
Abs Lock is not a medical or fitness device. The App is designed for general wellness and motivation. You should:
- Consult a healthcare professional before beginning any exercise routine
- Stop exercising immediately if you feel pain, dizziness, or discomfort
- Use the App at your own risk and within your physical capabilities
We are not responsible for any injuries or health issues arising from the use of the Services.
9. Disclaimer of Warranties
The Services are provided "AS IS" and "AS AVAILABLE" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that:
- The Services will be uninterrupted, secure, or error-free
- Rep counting will be 100% accurate in all conditions
- The Services will meet your specific requirements
- Alarms will fire reliably in all device and OS configurations
10. Limitation of Liability
To the maximum extent permitted by law, Abs Lock and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising out of or related to your use of the Services.
Our total liability for any claims arising from the Services shall not exceed the amount you paid us in the 12 months preceding the claim, or $50, whichever is greater.
11. Indemnification
You agree to indemnify, defend, and hold harmless Abs Lock and its affiliates from any claims, damages, losses, liabilities, costs, and expenses (including attorney's fees) arising from your use of the Services or violation of these Terms.
12. Modifications to the Services
We reserve the right to modify, suspend, or discontinue the Services (or any part thereof) at any time, with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of the Services.
13. Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the Services after changes are posted constitutes your acceptance of the revised Terms.
14. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Minnesota, United States, without regard to its conflict of law provisions.
15. Dispute Resolution
Any disputes arising from these Terms or the Services shall first be attempted to be resolved through informal negotiation. If the dispute cannot be resolved informally within 30 days, either party may pursue binding arbitration in accordance with the rules of the American Arbitration Association. You agree to waive any right to a jury trial or to participate in a class action.
16. Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.
17. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Abs Lock regarding the Services.
